Welcome to Made by K·A·I (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, products, and services available at madebykai.ca (the “Site”).
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use our Site.
Made by K·A·I is operated as a sole proprietorship under the name Made by K.A.I, based in Nova Scotia, Canada.
1. Eligibility
You must be at least 18 years old, or have permission from a legal guardian, to use this Site. By using this Site, you confirm that you meet this requirement.
2. Products & Services
2.1 Physical Goods (Merch & Print-on-Demand)
We offer original merchandise, much of it produced on demand through third-party print providers. Fulfillment and shipping of these items are handled by those providers and are subject to their production times and availability.
2.2 Digital Goods
We also offer digital content such as music, beats and stems, digital artwork, and downloadable resources. All digital goods are final sale. Once a file is purchased or made available for download, it cannot be returned or refunded, except where the file is corrupted or inaccessible (see our Refund Policy).
Digital goods and beats are licensed, not sold outright. You agree not to redistribute, resell, or modify digital goods except as expressly permitted by the licence accompanying your purchase.
2.3 Commissioned & Custom Work
We may offer custom or commissioned work (for example, custom music or web/development projects). Any such work is governed by a separate Service Agreement provided per project, which sets out scope, timeline, payment, deliverables, and intellectual-property ownership. Nothing on the Site constitutes an offer to perform commissioned work until a Service Agreement is executed.
3. Pricing & Payment
Prices are listed in Canadian dollars (CAD) and are charged at checkout via our third-party payment processor. We reserve the right to correct pricing errors and to refuse or cancel orders affected by them.
4. Order Acceptance
We reserve the right to refuse or cancel any order at any time for reasons including, without limitation: product availability, pricing errors, violation of these Terms, or suspected fraud.
5. Shipping & Delivery
Physical-product shipping costs and delivery estimates are shown at checkout. Delivery times depend on third-party production and logistics and may be affected by customs. Digital downloads are delivered by email/secure link after purchase — please contact us if you have trouble accessing your files.
6. Returns & Refunds
Returns and refunds are governed by our Refund Policy. In summary: physical items are eligible for replacement or refund only when defective, damaged, or incorrect; digital goods and beats are final sale; and shipping charges are non-refundable.
7. User Conduct
You agree not to:
- Use the Site for unlawful or unauthorized purposes;
- Copy, distribute, or sell content you do not own;
- Attempt to gain unauthorized access to our systems or other users’ data;
- Interfere with the Site’s functionality or security.
8. Intellectual Property
All Site content — including logos, artwork, text, code, audio files, and graphics — is owned by Made by K·A·I or its licensors and is protected by intellectual-property laws. You may not copy, distribute, or use our content for commercial purposes without written permission or a valid licence.
9. Third-Party Links
The Site may link to third-party websites. We are not responsible for their content, privacy practices, or terms.
10. Disclaimers
All products and services are provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties, express or implied, including merchantability or fitness for a particular purpose.
11. Limitation of Liability
To the extent permitted by law, Made by K·A·I shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our offerings.
12. Governing Law
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Nova Scotia.
13. Changes to These Terms
We may update these Terms from time to time. Changes are posted to this page with a revised effective date, and your continued use of the Site constitutes acceptance of the revisions.
